Justice Kayani criticizes the police for kidnapping a woman and two little girls.

“How is it justice to file five fake FIRs and abduct young girls and a woman?” asked Islamabad High Court (IHC) judge Mohsin Akhtar Kayani on Thursday. as the case involving the kidnapping of two young daughters and their mother was being heard.
The case involved a plea seeking the dismissal of the financial dispute-related FIR filed against former PIA CEO Musharraf Rasool, Waqas Ahmed, and Sohail Aleem. The FIA was instructed to carry out its inquiry by the IHC.
At this point, the FIA cannot issue any final orders, according to Justice Kayani. He pointed out that the proceedings will proceed in accordance with the Supreme Court’s (SC) directives, as the SC had already suspended a related verdict.
Additionally, he stated that the IHC would not address any issue in which the SC had limited authority.
Justice Kayani voiced his harsh disapproval of the Punjab and Islamabad Police’s activities during the hearing. “It is unacceptable to kidnap girls and a woman through five false cases,” he said.
He criticized the fact that the complainant who submitted the false reports had never been seen. “The Punjab CM is also a woman, and she should know her police is involved in abducting another woman,” the judge stated, adding that the case had been forwarded to Punjab Chief Minister Maryam Nawaz due to the kidnapping of a woman and young girls.
He added that bogus FIRs cannot be used to obtain financial compensation and that they wouldn’t even last five minutes during a trial. He said, “Don’t do this; these phony cases will fall apart during cross-examination.”
According to Justice Kayani, the recovery was mistakenly ascribed to the suspects, and the same kidnapped woman had belongings taken from her own house. He added that the petitioner had sold property valued at Rs. 310 million and was “not a clean man” either. He voiced his worry that senior police officers frequently condone the misconduct of their less experienced counterparts.
The judge made it clear that the court did not feel sorry for the petitioner and that he would face consequences if found guilty. According to him, the court has a responsibility to uphold fundamental rights and does not condone anyone engaged in unlawful activity. “The probe cannot be stopped. Examine the area where the mom and kids were kidnapped and report it,” he instructed.
Advocate Shehryar Tariq pointed out that although the November 5 ruling had already been made, the Supreme Court had delayed the October 24 ruling from the High Court. Latif Khosa, the petitioner’s attorney, contended that the authorities had even deceived the Supreme Court, which had suspended the October 24 ruling rather than the November 5 one.
“Until the Supreme Court issues a decision, we will not pass any order,” Justice Kayani said, directing both parties to examine the Supreme Court’s ruling. Justice Kayani said, “How would I know if I will even be here on the 27th?” in response to Khosa’s request that the next hearing be scheduled for the 27th.
With instructions, the court postponed the hearing to the next week.
