For an unauthorized second marriage, LHC orders the husband to provide the first wife an additional Rs 1 million.

The Lahore High Court has decided that if a husband remarries without his first wife’s consent, he must give her Rs 10 lakh as mehr. In her eight-page ruling on Mehnaz Saleem’s appeal, Justice Abid Hussain Chattha granted her request for mehr, maintenance, and the amount of her dowry.

The husband must promptly pay the first wife her mehr if he forms another marriage without her consent, the court said, amending the trial court’s ruling.

The first wife is also entitled to the value of her dowry and Rs 15,000 every month until the divorce takes effect.

In the past, the Supreme Court of Pakistan had decided that if a second marriage takes place without the first wife’s agreement, she could end the marriage contract.

The husband had concealed previous marriages and verbally divorced the first wife, which is against the law, according to the Lahore High Court.

The husband was liable for the wife’s financial support throughout the iddat time since the court noted that the wife was compelled to leave her home but chose not to do so because of misbehavior.

The first wife is entitled to her full mehr, maintenance, and dowry compensation, as the court also recognized that the husband’s omission to reveal previous marriages violated ethical and legal requirements.
