The Supreme Court of Pakistan no longer has the power to interpret the constitution and laws in light of the 27th Constitutional Amendment, according to a ruling by the Federal Constitutional Court of Pakistan.
In rendering the historic decision, Justice Aamir Farooq explained that the Supreme Court had the authority to interpret legal and constitutional provisions before the 27th Amendment.
This power now belongs exclusively to the Federal Constitutional Court under the new constitutional framework.
The court further declared that it has the authority to summon the records of any case pertaining to interpretation and can examine whether legislation is constitutional.
During the previous fiscal year, Pakistan borrowed $10.6 billion and paid $13.3 billion in debt.
Justice Farooq stressed that the 27th Amendment essentially eliminated the Supreme Court’s authority to examine laws and legal interpretations in the context of a sales tax issue.
By extending the Federal Constitutional Court’s authority in legal matters and changing the hierarchy of constitutional interpretation, the ruling represents a dramatic change in Pakistan’s judicial system.
