In his ruling in the case of the reserved seats, Justice Jamal Mandokhail of the Supreme Court (SC) partially approved the petitions against the majority decision.

According to the 12-page ruling made public by the Supreme Court, Justice Mandokhail has maintained his initial position on the 39 reserved seats.

The majority decision on the remaining 41 seats is wrong, according to Justice Mandokhail’s ruling. By arguing that the Court lacked the jurisdiction to declare these 41 candidates independent, he has changed the majority finding on these 41 seats into a review decision.

According to Justice Mandokhail, the ruling on the 41 seats is not consistent with the facts or the Constitution. The 41 candidates’ case was not pending in court, and the court has no authority to alter a candidate’s political allegiance. According to him, the majority’s choice over these forty-one nominees amounted to “exceeding its jurisdiction.”

As you may remember, 41 candidates were deemed independent in Justice Mansoor Ali Shah’s majority ruling. These 41 candidates were granted more time to choose their party affiliation by the July 12, 2024 judgment.
