Judges of the IHC are fighting the move of an intra-court appeal to the Federal Constitutional Court.

Judges from the Islamabad High Court have asked the Federal Constitutional Court to consider their case within the court.
Four judges from the IHC submitted a petition asking that the intra-court appeal be sent back to the Supreme Court. The justices said that the appeal was sent to the constitutional court because of the 27th Constitutional Amendment, yet the amendment itself goes against the Constitution.
In their petition, they said that the Constitution of 1973 set up the legislative, executive, and judiciary. This Constitution is founded on three pillars. The Constitution makes it quite clear what each branch of government can and can’t do. They also said that the ability to change the Constitution cannot be utilized to get rid of or weaken the courts.
The judges also said that Supreme Court decisions make it quite clear what the rules are for the separation of powers.
