The Federal Constitutional Court reverses the Supreme Court’s decision to demolish the Monal restaurant.

Accepting petitions from the Capital Development Authority (CDA) and the Metropolitan Corporation, the Federal Constitutional Court reversed the Supreme Court’s ruling mandating the destruction of Monal Restaurant in Pir Sohawa. Additionally, the court ordered trial courts to resolve the outstanding matters as soon as possible and revoked the stay order.
The Constitutional Court held that while administrative issues will be settled by the appropriate regulatory bodies, ownership disputes must be resolved by trial courts independently and without the influence of judicial opinions.
The bench was informed by counsel Ahsan Bhoon that the court had carefully considered the case. Justice Hassan Azhar Rizvi responded by requesting that counsel refrain from praising the bench, adding that the court would base its decision solely on the proceedings and would not incorporate unrelated storylines.
After reading the Supreme Court’s ruling, Justice Hassan Azhar Rizvi added that it seemed that a number of observations had been made that went beyond the parameters of the court procedures.
